Holiday Award
Sep 19, 2018 - 2:01 PM - by Lussos
17456 and 17461 Arbitrator Chin Denying Holiday Pay; in these cases the Union argued that these employees on Thanksgiving Day called in leave without pay due to the unexpected illness. Because of their unexpected illness it rose to an emergency which qualifies them for Holiday pay; previously, the Service denied the employees holiday pay. The cases were heard in front of Arbitrator Chin where the arbitrator denied the cases because their call in did not rise to an extreme emergency as provided for under the National Agreement Section 11.6C.

The union argued that management must utilize employees in the immediate work area for the higher level work, and if there are no takers in the area, management must go to the tour list for available and qualified employees; step two decision agrees to the higher level pecking order.
